DMCA

At Oh Hello Vegan, we take intellectual property rights seriously and are committed to complying with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable intellectual property laws. This page outlines our DMCA policy, how copyright owners can submit infringement notices, and how alleged infringers may respond.

Our website — https://ohhellovegan.com — provides recipes, lifestyle tips, images, videos, and written content related to the vegan lifestyle, including our focus on high-protein vegan breakfast recipes. We respect the creative work of others and expect our users, contributors, and partners to do the same.

1. Purpose of This Policy

The DMCA is designed to balance two important interests:

  1. Protecting the rights of copyright holders whose works are used without authorization.
  2. Ensuring that websites hosting user-generated content are not unfairly penalized for material they did not create or control.

Oh Hello Vegan is both a creator of original content and, occasionally, a platform for community-submitted recipes, images, and tips. Because of this, it’s possible that material uploaded or submitted by third parties may inadvertently infringe on someone else’s copyright.

2. Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that material available on ohhellovegan.com infringes upon your copyright, you may submit a DMCA takedown notice to our Designated Agent.

Your notification must be in writing and include the following information as required by the DMCA (17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work you claim has been infringed. If multiple copyrighted works are covered by your notice, you may submit a representative list.
  2. Identification of the infringing material and information sufficient for us to locate it on the site (URL or direct link preferred).
  3. Your contact information — including name, mailing address, telephone number, and email address — so that we may respond to your notice.
  4. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
  6. Your physical or electronic signature.

3. How to Submit Your DMCA Notice

Please send your DMCA notice to our designated agent:

Designated DMCA Agent
Oh Hello Vegan
Email: [email protected]
Address: Zentralstrasse 18, 8610 Uster, Switzerland
Phone: +41 44 510 9900

Important: Submitting a false DMCA claim can result in legal liability for damages, including costs and attorney’s fees. Please ensure you have the legal right to file the claim before sending a notice.

4. What Happens After You File a Notice

Upon receiving a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the content uploader that their material has been removed or disabled.
  • Provide the uploader with instructions on how to file a counter-notification if they believe the material was removed by mistake or due to misidentification.

5. Filing a Counter-Notification

If you believe that your material was removed or disabled by mistake, or because it was misidentified, you may file a counter-notification.

Your counter-notification must include the following:

  1. Identification of the material that has been removed or disabled, and the location where it appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good-faith belief that the removal or disabling of the material was a mistake or that the material was misidentified.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., that you consent to jurisdiction in any district where the service provider is located), and that you will accept service of process from the person who provided the original infringement notice or an agent of such person.
  4. Your physical or electronic signature.

Send your counter-notification to our Designated Agent at the contact information above.

6. Repeat Infringers

In accordance with the DMCA and other applicable laws, Oh Hello Vegan will terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

7. Use of Third-Party Content

Oh Hello Vegan may use third-party images, videos, and quotes under:

  • Licenses or permissions obtained from the copyright holder.
  • Creative Commons licenses or other open-use terms.
  • Fair use provisions of copyright law for purposes such as commentary, education, or criticism.

We make reasonable efforts to credit original creators and link to the source when required by license terms. If you see material on our site that you believe has been used improperly, please contact us directly rather than assuming intentional infringement.

8. Educational & Recipe Content Considerations

Because our website focuses on vegan recipes and lifestyle content, it’s important to note that:

  • Ingredients lists and basic cooking instructions are generally not protected by copyright under U.S. law.
  • Creative expression in recipe descriptions, photographs, and accompanying stories is protected by copyright.
  • If you submit a recipe to Oh Hello Vegan, you confirm that you own the rights to the recipe’s creative expression (or that it’s free to use) and grant us permission to publish it.

9. International Users

While the DMCA is a U.S. law, we are based in Switzerland and serve an international audience. We follow DMCA procedures as a best practice and also comply with applicable copyright laws in other jurisdictions. If you are outside the United States, please provide the equivalent legal requirements when submitting your notice.

10. Good-Faith Resolution

We believe that most copyright disputes can be resolved without legal escalation. If you believe your work has been used in a way that violates your rights, we encourage you to first contact us informally at [email protected]. Many issues can be resolved quickly through direct communication, such as adding proper attribution or removing the material voluntarily.

11. Policy Updates

We may update this DMCA policy from time to time to reflect changes in the law or our practices. Any updates will be posted on this page with a revised “Last Updated” date.
